County commissioners to debate road money versus Tri-Rail aid

County commissioners are set to debate today whether to back state legislation that would take money away from high-priority county road projects and give it to just-as-important mass transit programs and Tri-Rail.

Florida Department of Transportation officials say the shift would deplete funding for several local road projects, like an overpass in Riviera Beach and other major construction meant to help cruise-ship passengers entering the Port of Palm Beach, as well as an expansion project to help motorists on State Road 7 in Palm Beach County.

Other projects that could be delayed are scheduled improvements for State Road 811 from the Broward County line to Southwest 18th Street in south Palm Beach County, as well U.S. 1 expansions from south of Glades Road to north of Yamato Road.

The Redwood City company (NASDAQ: MAXY) will reorganize its legal workers to take on his work when he leaves. Norman Kruse, the company's chief patent counsel, will now report directly to CEO Russell Howard. John Borkholder was promoted from senior corporate counsel to chief corporate counsel and also corporate secretary.

Maxygen hired Rabson in September 1999 from Wilson Sonsini Goodrich & Rosati.

Maxygen seeks drugs for hemophilia, rheumatoid arthritis, and neutropenia.

The company also promoted Grant Yonehiro to chief business officer -- he's worked at the company since May 2003. Yonehiro worked previously at Cell Genesys and in the technology transfer office at Lawrence Berkeley National Laboratory.

Penalties piling up for nursing home

A Davenport nursing home faces $25,500 in state fines for poor care of its residents.

ManorCare also faces federal fines of $450 per day, which so far total $12,150.

The nursing home's state license has been placed on conditional status, and government officials have prohibited ManorCare from admitting new residents who depend on Medicare or Medicaid to pay for their care.

E-mail scam has deadly message

Fengel urges anyone who receives a threatening e-mail to either delete it or drop it in their junk mail folder. If the recipient truly believes their life is at risk, then they should call police immediately.

FBI officials recommend not replying to the sender. Doing so may signal to the sender that they've reached a live e-mail account and further intimidation attempts could be made.

E-mails like this or ones claiming the recipient has won a lottery or sweepstakes as way to extort money from innocent people are hard to trace because they usually originate in Nigeria or Canada, police said.

"The bottom line is they're wanting money," Fengel said of the hoaxes. "There are people out there who work really hard at trying to rip people off rather than make an honest living."

Further investigation revealed the child was not injured during the first diaper change by daycare staff. The injury to the child was noticed by the daycare staff but no one notified the police department or child protective services.

Terrance Charles Beard was interviewed by police detectives and admitted that he did assault the 4 month old child.

The case was screened by the Bell County District Attorney's office and a complaint was returned charging Beard with Aggravated Sexual Assault to a Child. Beard was arraigned by Justice of Peace Garland Potvin and a bond of $200,000.00 dollars was set.

He is in the process of being transferred to the Bell County Jail.
